Terms and conditions

These General Terms and Conditions ("GTC") apply to all orders and contracts concluded via our website or by other means between consumers and Lupine Lighting Systems GmbH. All offers, deliveries, and services are provided exclusively on the basis of these GTC.

Our product presentations are non-binding. By submitting an order, the customer submits a binding offer. The contract is concluded when we confirm the order in writing or ship the goods. Our sales staff are not authorized to make verbal promises or deviate from the written contract.

All prices are quoted in euros (€) and include German VAT unless otherwise stated (e.g., for customers outside the EU). Shipping costs, as well as any applicable customs duties or import taxes, are borne by the buyer. Payment is possible by Visa and Mastercard, PayPal, or advance payment. In advance payments, shipping will only occur after full payment has been received. For credit card payments, the order must include the card number, expiration date, and security code (CVV). Payment information is processed using secure, encrypted methods and handled in accordance with data protection laws.

Shipping is via DHL or UPS. For deliveries within Germany, a
A flat shipping fee of €4.90 applies. International shipping costs are calculated either as a flat rate or individually depending on the destination and are displayed during the ordering process. Unless expressly agreed otherwise in writing, delivery times are non-binding. We are not liable for delays caused by force majeure (e.g., natural disasters, customs delays). We reserve the right to refuse delivery if the buyer is in default of existing obligations.

The risk of accidental loss or deterioration of the goods passes to the buyer when they leave our warehouse – even in the case of freight-free or insured delivery.

The goods remain our property until all claims arising from the business relationship have been paid in full. The buyer is obligated to inform us immediately if third parties access the goods (e.g., by seizure). Asserting the retention of title does not constitute withdrawal from the contract.

Consumers have the right to withdraw from the contract within 14 days without giving any reason.
Cancellation instructions, including a sample cancellation form, will be provided separately. The buyer bears the return shipping costs unless otherwise agreed.

Returns require our prior written approval. Refunds will be made via the original payment method, unless otherwise agreed.

All product information is provided to the best of our knowledge, but does not release the buyer from their own examination of suitability. Defects must be reported immediately upon receipt, but no later than within 14 days. Hidden defects must be reported upon discovery, but no later than 24 months after receipt. Excluded from the warranty are lamps and batteries, as well as damage caused by improper use, modifications, unauthorized repairs, accidents, or external factors.
Influences. Warranty claims are non-transferable and valid only for the original purchaser. In the event of defects, we reserve the right, at our own discretion, to repair, replace, reduce the purchase price, or refund. Returns are only accepted with prior written consent. If the buyer is a business, the goods must be inspected for defects immediately upon receipt; otherwise, they are deemed accepted. For businesses, the warranty is limited to repair, replacement, or reduction of the purchase price at our discretion. Returns require our express consent.

We accept unlimited liability in cases of intent, gross negligence, and injury to life, limb, or health. In the case of slightly negligent breaches of essential contractual obligations, liability is limited to the damage typically foreseeable under the contract. We assume no liability for improper use, in particular for use not permitted in Germany. Liability under the Product Liability Act remains unaffected.

In case of late payment, we reserve the right to charge a reminder fee of 5 € per reminder as well as
Default interest at a rate of 4% above the base interest rate of the Deutsche Bundesbank will be charged. Further claims remain reserved.

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act. For details, please see our privacy policy.

These Terms and Conditions and all contracts with consumers are subject to the law of
Federal Republic of Germany. If you are a consumer residing in another EU member state, the mandatory consumer protection regulations of your country remain unaffected. The place of performance and exclusive jurisdiction for all disputes is our registered office, unless mandatory legal provisions provide otherwise.

The standard housing color is black anodized. For special colors or customized models

Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

We reserve the right to update these Terms and Conditions from time to time.
